I. Description of Services

EternalClock is a digital platform for users worldwide. We offer a precision lunar calendar with the following features:

• Digital lunar calendar with precise new crescent calculations
• iCal file downloads for integration into personal calendars
• Access to multiple years depending on your subscription plan
• Flexible subscription plans (Silver, Gold, Founding Patron)
• Responsive customer support and technical assistance

II. Intellectual Property

All elements constituting and integrating the EternalClock site are the exclusive property of EternalClock (brand of Engravethevision LLP), including:

• Logos, images, graphics and text
• Content, databases and calculation algorithms
• Photographs, names and trademarks
• Source code and technical architecture

Important: Any user browsing EternalClock agrees not to reproduce, copy, modify, distribute or use the data that comprises it, regardless of its nature, without prior written authorization.

III. Right to Image and Privacy

Any EternalClock user who publishes or uses on the site the image of a person or content likely to infringe on a person's privacy must have obtained prior express authorization. The user must guarantee the publisher in this regard and is solely responsible for the consequences of publishing on the site content that would represent the image of third parties or that could infringe on their privacy.

IV. Rules of Conduct

It is prohibited on the EternalClock site:

• To benefit from its services if you are a minor
• To communicate confidential personal data in fields intended for internet users
• To use its services for illegal purposes
• To publish any content contrary to public order and good morals
• To constitute a criminal offense (defamatory, insulting, racist data, etc.)
• Any form of fraud and abuse of confidence
• To usurp the information of site users
• To copy and modify the data that comprises the site
• To harm the interests and property of EternalClock and its users
• To distribute or publish spam or junk mail

VI. Responsibilities and Exemption

EternalClock is committed to providing you with quality services. By using the EternalClock site, you acknowledge that it does not guarantee:

• The authenticity and accuracy of information communicated by members
• The absence of misuse of our services by third parties
• The absence of errors or interruptions in cases of force majeure (technical maintenance, temporary inability to access the site)
• That personal information provided by the user is complete, current and correct

EternalClock exempts itself from all responsibility in case of abnormal use, illicit exploitation, loss by the user of his password, but also in case of usurpation of his identity, attack or computer hacking. Limitation of liability: Our total responsibility does not exceed the amount you have paid over the last 12 months.

VII. Use of Cookies

In order to facilitate navigation on the EternalClock site, cookies may be placed on your computer to, for example, preserve search criteria and your language preferences. VIII. Penalties

In case of non-compliance with the Terms of Use, as well as with legal and regulatory provisions, EternalClock reserves the right to:

• Issue warnings
• Temporarily or indefinitely suspend a user account
• Delete information
• Block an IP address
• Impose any other appropriate sanction

EternalClock may inform the competent authorities for any dissemination contrary to public order, good morals and applicable laws.

IX. Termination Condition

You may cancel your registration at any time in your account or contact us at: [email protected]. The user is aware that his services are activated as long as his payments are made for the services rendered. If you opt for a monthly subscription and after one month you no longer pay your subscription, your services will be interrupted. Your subscription remains active until the end of the current billing period. Your remaining credits remain valid until the end of your subscription period. After expiration, all unused credits will be lost.

X. Pricing and Subscriptions

We offer several monthly and annual subscription plans adapted to the needs of our users. Each plan includes access to different years of the lunar calendar. To find out current prices and the benefits of each plan, visit our Plans page. Subscription fees are billed automatically each month or year, depending on your plan. Your subscription renews automatically at the end of each billing period.

XI. Payment Terms

The user can make payment by credit card via the secure Stripe interface. All payments are encrypted and secure. Stripe uses the strictest security standards in the industry (PCI DSS Level 1). We never have access to your credit card information. If your payment fails, we will send you an email notification. You have 3 days to update your payment method. After 3 days, your subscription will be suspended.

XII. Refund Policy

EternalClock is a continuous digital service. Once access is activated and the service has been executed, the refund policy depends on your plan: Silver and Gold Plans: No refund is possible after the service has been executed (access to the calendar and iCal download). Diamond Plan (Founding Patron): Due to the nature of this lifetime investment, if you encounter a technical defect preventing total access to the service within 7 days of purchase, we will offer a full refund or equivalent credit. A 7% processing fee will apply to the refund to cover Stripe fees, administrative fees and bank fees.

XIII. Jurisdiction and Applicable Law

Any dispute that may arise concerning these General Terms and Conditions of the EternalClock site shall be subject to an attempt at amicable settlement between the parties. These general conditions are subject to the Code of Civil Procedure of London in the United Kingdom which determines, on a case-by-case basis, the law that will be applied.
